|  TERMS OF SERVICE

This agreement is between myself, bellufo (the "Artist"), and you (the "Client"). The client is hiring the Artist for a commission hereafter referred as "commission" and/or "artwork".Failure to comply with this Terms of Service may result in ban from future commissions, and will result in all rights and ownership to the commissioned artwork rescinded.I, the Artist, am not responsible if the Client fails to read/ confirm the Terms of Service. The Client is responsible to clarify with the Artist any policy they are unsure of.

GENERAL

・ Do not trace, reproduce any of my artwork
・ Do not edit, modify any of my artwork without my consent
・ Do not claim the artwork as your own creation
・ Do not use my artwork for AI-related activities, such as (but not limited to) AI training and AI generated works
・ Do not use my artwork for any blockchain-related activities, such as (but not limited to) NFTs and cryptocurrency

COMMISSIONS

・ Process and approximate work time per commission type are listed in their respective pages
・ Work queue & waitlist is available here
・ The commission slot is reserved and work time starts after payment is settled
・ I reserve the right to decline any commission
・ Not first come first serve. I arrange my work with consideration to deadlines, complexity, my capacity
・ All commissions are delivered digitally

・ There are 2 rounds of revisions per process checkpoint

↳ Revisions past the above mentioned 2 rounds will incur additional charges
↳ Revisions that backtrack the checkpoint will incur additional charges, such as (but not limited to):
- Example 1: changes to the lineart during colouring, redesigns after sketch confirmation/
- Example 2: redraws and additional work due to incorrect/ unclear references or instructions
↳ Additional charges will be determined by the complexity and time needed to complete the change

PAYMENT

・ Payment will be through Paypal Invoice, or paid at my Ko-fi
・ All prices are listed in USD
・ Payment will be upfront in full unless otherwise discussed
・ Payment plan available for commissions above $200

↳ min$100 per part, flat fee +$3.5 per part

・ Rush Commissions & Priority Queue

↳ +$100 or 50% of the total commission cost, whichever higher
↳ I will start your commission immediately or latest within the following week
↳ Charges may increase pending the Client's urgency/ time requirement

・ Private Commissions

↳ +$100 or 75% of the total commission cost, whichever higher
↳ Private commissions mean that the artwork process cannot be shown on my streams or social medias
↳ and/ or the final artwork cannot be showcased on my social medias and public portfolios within 28 days*
↳ and/ or the final artwork cannot be showcased on my social medias and public portfolios at any time↳ *If the commission can only be shown 28days or later after completion, you can discuss with me and time the start of your commission to avoid this!! Feel free to inquire!↳ I will never show (on stream) references or images from the Client without permission! You do not need private commission for this!

・ Commercial Rights

↳ +50% of the total commission cost
↳ This Commercial Rights charge is required if you intend to use the artwork for mass printing, mass distribution and/ or profitable activities, , such as (but not limited to):
- Examples 1: mass distribution of an artwork as a reward for a subscription tier
- Examples 2: printing the artwork for sale
- Examples 3: using the artwork in creating merch for sale↳ Commercial Rights not required for use of the artwork in monetized streams/ monetized posts/ video thumbnails
※ Do not hesitate to ask me for clarification on any uses!! Inquiries welcome

・ Other Charges

↳ Complex designs may increase the commission cost
↳ Any additional design work may require extra charges, such as: new character/ mascot/ outift without references, insufficient references that may require some designing to be done to fill in the blanks.

REFUND & CANCELLATION

・The Client must never request/ submit a Paypal chargeback under any circumstances. This will be considered a violation of my Terms of Service. If a refund has been agreed on, I will transfer the funds to you per our agreement
・Platform fees will not be refunded・I will refund in the following circumstances:

↳ Work for the commission have not started, and 30 days have passed after payment
↳ I, the Artist, cancels the commission for reasons relating to my inability to finish the Work, or for any misbehaviour or violation committed by the Client

・For cancellation mid-commission requested by the Client, a partial refund may be available but not guaranteed - the Artist will discuss with the Client with consideration to work done and workflow of said commission

・Upon cancellation, partially completed work will not be sent to the Client
・I, the Artist, maintain the right to reuse/ modify/ adopt the work in progress for another design/ artwork/ commission. Naturally I will not directly reuse any concepts unique to the previous Client, but will modify/ adopt them appropriately

CREDITING THE ARTIST

・ Please credit me as "bellufo" or mention @__bbbell on X/ Twitter
・ For credits, please kindly link to https://x.com/__bbbell or https://bellufo.carrd.co

USAGE RIGHTS

・ I, the Artist, own the intellectual property rights & copyrights to the artwork and any original designs. The intellectual property rights of the existing characters drawn belong to their respective owners.
・ Commissioned artwork are for personal use only unless otherwise discussed and Commercial Rights bought
・ I, the Artist, maintain the rights to show the commission progress and completed artwork at any time, this may be in the form of streaming on Twitch, posting on X/ Twitter, showcasing for portfolio-purposes on my commission webpages

↳ The above is overwritten by any agreement made with the Client for a Private Commission

・ Regarding reselling the commissioned artwork: I will only consider the scenario where a Client decides to resell their persona with the commissioned artwork included as the bundle. The Client must contact me to discuss and agree on the reselling and details
